The Death of Daverion Kinard

Daverion Deauntre Kinard was a 28-year-old man from Fontana, California, whose life ended tragically in February 2021 during a police encounter that drew national attention. Kinard’s death has become part of ongoing conversations about police use of force, accountability, and transparency in law enforcement.

The incident began when police responded to a 911 call reporting a burglary in progress. According to authorities, Kinard had entered a home through a window. When officers arrived at the scene, Kinard fled, leading police on a brief foot pursuit. The chase ended when officers discovered Kinard hiding inside a portable bathroom near the location of the reported burglary.

Body camera footage released later by the Fontana Police Department shows the confrontation. An officer opened the door to the portable bathroom, and within seconds of seeing Kinard, a shot was fired, striking him fatally. Police initially stated that Kinard appeared to be holding a metallic object they believed was a weapon. However, it was later confirmed that the object was actually a lighter, and no weapon was found at the scene.

Kinard’s death occurred just one day before his 29th birthday, adding to the tragedy of the situation. The family immediately expressed grief and concern over the circumstances surrounding the shooting. In response, Kinard’s parents filed a legal claim against the city of Fontana, seeking accountability and justice for their son.

In June 2021, the city reached a settlement with Kinard’s family, agreeing to pay $1 million. As part of the settlement, the family and city agreed not to publicly disparage one another. The family also requested that the body-camera footage of the shooting not be released in order to protect Kinard’s dignity, though state law required its eventual disclosure.

The officer involved in the shooting, identified in public reports as Johnny Tuitavake, remained with the department, and investigations were conducted to determine whether proper procedures had been followed. The case highlighted the speed at which police encounters can escalate and raised questions about decision-making in high-pressure situations.

Kinard’s death drew attention from the broader public and media, becoming part of the ongoing discussion about the use of deadly force against unarmed individuals, particularly Black men, in the United States. Advocates and community members called for reforms and greater transparency in law enforcement to prevent similar tragedies in the future.
