A Sangamon County judge has issued a significant pretrial ruling in the high-profile murder case against two former emergency medical workers charged in the death of Earl Moore Jr., limiting what evidence prosecutors may present while allowing a defense medical expert to testify at trial.

The case stems from the December 18, 2022 death of 35-year-old Earl Moore Jr., who died after being transported by ambulance in Springfield, Illinois. Moore’s death was later ruled a homicide, with an autopsy determining the cause as compressional and positional asphyxia. Authorities allege he was strapped face-down on a stretcher during transport, which impaired his ability to breathe.

Former EMS workers Peter Cadigan and Peggy Finley were each charged with first-degree murder in connection with Moore’s death. Prosecutors argue that the decision to secure Moore in a prone position during transport created a strong probability of death or great bodily harm, meeting the legal threshold required under Illinois law for the charges.

During a recent hearing in Springfield, Robin Schmidt of the Sangamon County Circuit Court ruled that certain hospital and EMS internal protocols would not be admitted as evidence at trial. Prosecutors had sought to introduce those protocols to demonstrate that the defendants violated established standards regarding patient positioning and restraint during ambulance transport.

Defense attorneys objected, arguing that internal hospital policies do not automatically establish the legal standard for criminal liability and could improperly influence jurors by suggesting that a policy violation equals murder. The judge agreed that introducing the protocols as substantive evidence could create confusion about the legal standard the jury must apply. As a result, the court barred the prosecution from using those documents to define the standard of care in the criminal case.

At the same time, the judge allowed the defense to call a medical expert witness to testify about causation and emergency medical practices. The expert is expected to challenge the prosecution’s claim that prone positioning alone caused Moore’s death and may offer alternative medical explanations or context regarding emergency response decisions made at the scene.

The ruling represents a strategic development for both sides. Prosecutors will still rely on autopsy findings, body camera footage, and witness testimony to argue that the defendants knowingly engaged in dangerous conduct. The defense, meanwhile, will seek to frame the incident as a tragic medical situation rather than an intentional or knowing act that rises to the level of murder.

Legal observers note that the case raises complex questions about how criminal law intersects with medical decision-making in high-stress emergency situations. Under Illinois law, first-degree murder requires proof that a defendant knew their actions created a strong probability of death or serious bodily harm. Whether jurors believe that standard has been met will likely hinge on expert testimony and interpretations of medical evidence.

The case continues to move toward trial, with additional hearings expected as attorneys finalize witness lists and evidentiary issues. If convicted, the defendants could face lengthy prison sentences
